What does 214(b) refusal mean?

Section 214(b) of the Immigration and Nationality Act presumes every non-immigrant visa applicant intends to immigrate, and the applicant must overcome that presumption. A 214(b) refusal means the consular officer was not convinced — usually because of weak ties to India, an unclear funding story, or inconsistent answers about post-study plans. It is not a lifetime ban; you can re-apply once you have addressed the underlying weakness. About 76% of our re-applications after a 214(b) get approved on the second attempt.

How early should I apply for an F-1 visa?

You can apply up to 365 days before your I-20 program start date, but you cannot enter the US more than 30 days before. Start the F-1 process the day your I-20 arrives. Most Nadiad students apply 3 to 4 months before classes begin — early enough to handle a re-interview if needed, late enough that consulate slot pricing is competitive. Mumbai consulate slot availability in 2024-2025 has been the bottleneck, not the visa officer.

Can I bring my spouse on an F-2 visa?

Yes. Your spouse and children under 21 can apply for F-2 dependant visas. F-2 spouses cannot work in the US, but they can study part-time (vocational only — full-time degree programs require their own F-1). We file F-2 applications alongside the principal F-1 when the consulate slot is available, and prepare the spouse for the same kind of interview rigour.

What is OPT and STEM OPT?

OPT (Optional Practical Training) is 12 months of work authorisation in your field after course completion. STEM OPT is a 24-month extension available only if your degree program's CIP code is on the official STEM list (most engineering, computer science, mathematics, natural sciences). Total post-study runway is 12 months for non-STEM and 36 months for STEM. STEM OPT requires you to work for an E-Verify employer and submit progress reports. We help with both filings.

How much funds do I show for a US visa?

At minimum the first-year cost on your I-20 — tuition plus living, usually USD 35,000 to USD 70,000 depending on university. We recommend showing 1.5 to 2 years of cost in liquid, FDs and sanctioned loan letters combined, with a credible source-of-funds story across 3 years of parent ITR. Officers do not need every paisa demonstrated, but they need to see the funding story is not assembled overnight.

Can I work in the US as an F-1 student?

On-campus you can work up to 20 hours per week during the academic year and full-time during scheduled breaks, no separate authorisation needed. Off-campus work is restricted: only Curricular Practical Training (CPT) for course-related internships during studies, then OPT after graduation. Working off-campus without authorisation is a serious F-1 violation that can terminate your status. We brief carefully at pre-departure.

Mumbai or Delhi — which consulate is better for Nadiad?

Mumbai is geographically closer (about 8 to 10 hours by car or train from Nadiad), and it is the consulate most Charotar students default to. Delhi is sometimes opened up if Mumbai slots are booked out. We monitor both calendars and book the first available reasonable date. Hyderabad is also an option for southern bookings if neither Mumbai nor Delhi has slots in your window.

Is GRE compulsory for US master's?

No, not anymore for many programs. Since 2021 a large number of US universities have made GRE optional or waived it permanently — especially in computer science, business analytics and engineering management. We map your target university list against GRE requirements and only recommend GRE if the schools you want still demand it or if a strong score will lift your scholarship chances.

What is the SEVIS fee and when do I pay it?

SEVIS (Student and Exchange Visitor Information System) fee is currently USD 350 for F-1 visas. It is paid online at fmjfee.com after you receive the I-20 and before you book the consular appointment. The receipt must be carried to the consulate. The fee is reviewed periodically by SEVP; confirm the current figure with our team before payment.

How long is an F-1 visa valid?

F-1 visa stamps for Indian students are typically valid for the program length, often 5 years for master's and PhD students (visa stamp), but you can stay in the US 'duration of status' (D/S) — meaning as long as you are enrolled and maintaining status, the actual visa stamp expiry does not matter while you are inside the US. The stamp must be valid only when you re-enter after travel abroad.

Does a 214(b) refusal show up forever?

It is recorded in the consular system, but it is not a ban. You can re-apply as soon as you have a meaningful change in your circumstances — better-prepared answers, clearer funding, an updated SOP, sometimes a different I-20. We always re-apply at the same consulate where the refusal happened and address the specific weakness honestly. About 76% of our re-applications after 214(b) get approved on the second attempt.

Can I switch from F-1 to H-1B without leaving the US?

Yes. F-1 to H-1B is the standard runway. After OPT (and STEM OPT if applicable) you become eligible for the H-1B annual lottery; if your employer files and you are selected, you can change status from inside the US without travelling home.
